Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the SpendForensics website and service (the “Service”), operated by Accord Analytics (“we”, “us”, “our”), based in Perth, Western Australia, Australia. By using the Service, you agree to these Terms.

1. The Service

SpendForensics is a self-service tool that performs forensic-style analysis on a procurement dataset you provide, and delivers a report. Analysis is performed in your browser; the report is stored on our servers so it can be revisited via a unique link.

2. Eligibility and acceptable use

  • You must be at least 18 years old and able to enter into a contract.
  • You confirm you are authorised to upload the dataset you provide and that doing so does not breach any confidentiality obligation, contract or law.
  • You must not use the Service to process data that identifies natural persons beyond what is incidentally present in typical procurement records (e.g. vendor contact names), and you must not upload payment card data, health information or government identifiers.
  • You must not attempt to reverse-engineer, disrupt, scrape or overload the Service, or use it to build a competing product.

3. Fees, tax and refunds

  • The price for a single report is USD $99, charged once at checkout via Stripe.
  • Australian customers are charged Goods and Services Tax (GST) in addition to the base price. Tax is calculated automatically by Stripe based on your billing details.
  • Because the report is generated and made available immediately, all sales are final and non-refundable, except where required by law (including non-excludable rights under the Australian Consumer Law).

4. Your data and our data-minimisation model

You retain all rights in the dataset you upload. We do not store your source data; only the analysis findings needed to render your report are transmitted to our servers and retained. See our Privacy Policy for detail.

You grant us a limited licence to process the findings solely to operate the Service and deliver your report to you.

5. Reports and expiry

Each report is accessible via a unique link and gated by the email address you provide at checkout. Reports automatically expire and are deleted 1000 days after creation. Export or save your report before that date if you need long-term access.

6. No professional advice

SpendForensics is a screening and diagnostic tool. Its findings are probabilistic indicators, not conclusions of misconduct, fraud, or breach. Reports do not constitute legal, accounting, audit, forensic-accounting or investigative advice. You are responsible for independently verifying any finding before acting on it, and for engaging appropriately qualified professionals where warranted.

7. Availability

We provide the Service on an “as available” basis. We may modify, suspend or discontinue any part of the Service at any time. We aim to give reasonable notice where changes materially affect existing paid reports.

8. Warranty disclaimer

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that findings will be complete or free from false positives or false negatives. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other law which cannot be excluded.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or related to your use of the Service is limited to the fees you paid to us in the twelve (12) months preceding the event giving rise to liability. We are not liable for indirect, incidental, consequential, special or punitive damages, or for loss of profits, revenue, data or business opportunity.

10. Indemnity

You will indemnify us against any claim arising from (a) your breach of these Terms, (b) your unauthorised upload or misuse of data, or (c) your reliance on report findings without independent verification.

11. Governing law

These Terms are governed by the laws of Western Australia, Australia. You and we submit to the exclusive jurisdiction of the courts of Western Australia, subject to any non-excludable right you have to bring proceedings in the jurisdiction of your residence.
